MarketSpark values your business and is committed to protecting your privacy. This Privacy Policy (“Policy”) sets forth our policies and practices for the collection, use, and sharing of your information, including when you visit our website at https://www.marketspark.com and related pages (our “Website”).

Please read this Policy carefully to understand our practices regarding your information and how we will treat it. We reserve the right to update or modify this Policy from time to time (see Changes to Our Privacy Policy below). We encourage you to review this page periodically for the latest information on our privacy practices. Where applicable data protection laws require us, we will provide appropriate notice, and take any necessary action, should we make any material changes to our practices.

Children’s Personal Information. Our Website is not intended for children under the age of 16. We do not knowingly collect, sell, or share personal information from children under 16. If you are under the age of 16, do not use or provide any information on our Website, including providing any information about yourself to us. If we learn we have collected or received personal information from a child under the age of 16 without parental consent, we will delete that information. If you believe we have any information from a child under the age of 16, please contact us (see Help below).

  1. COLLECTION OF INFORMATION

We collect information when you visit our Website, use our apps, contact us, when you subscribe to and use our wireless service, and when you otherwise interact with us.

We collect information you provide directly to us. When you fill out forms on our Website, ask us a question, or correspond with us we collect certain information from you, including your name, email address, company name and information about how your company may use our services, phone number, postal address, Social Security number, and date of birth), a username and password, payment information, and any additional information you provide in any communication you send to us. If you are interested in applying for a position with us, we collect your email address and any additional information that you submit to us, including information provided on your CV and cover letter, which may include your work experience, educational background, any relevant certifications, and references.

We collect information when you use our service. This includes information about the calls you make and receive, text messages you send and receive, websites you visit, mobile applications you use, and wireless network and device information, including location, Internet protocol (IP) address and connection speed, mobile telephone number, device and advertising identifiers, browser type, and operating system.

We also collect information automatically when you visit our Website and use our apps, including through cookies and similar technology. As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including your IP address, device, and advertising identifiers, browser type, operating system, pages that you visit before and after visiting our sites, the date and time of your visit, information about the links you click and pages you view within the sites, and other standard server log information.

We may use cookies, pixel tags, and similar technologies to automatically collect this information. Cookies are small bits of information that are stored by your computer’s web browser. Pixel tags are very small images or small pieces of data embedded in images, also known as “web beacons” or “clear GIFs,” that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. By using our websites and applications, if you haven’t opted out of our collection of cookies by accessing our cookie banner, you consent to our use of cookies and similar technologies.

How you can control cookies.  Most browsers are initially set up to accept cookies. However, if you prefer not to store cookies on your device, you can set your browser to notify you when you receive a cookie, set your browser to refuse cookies by activating the appropriate setting on your browser, delete cookies after visiting our site, or browse our site using your browser’s anonymous usage setting. Social Media. At the bottom of our Website home page, we provide links to our social media pages (e.g.,YouTube.MarketSpark, LinkedIn.MarketSpark). No personal information is transmitted to these social media via our Website unless you click on the links to the correspondent social media.

When you interact with our social media pages, we receive basic engagement metrics and use this information to improve our pages and enhance our content and marketing efforts. If you interact with these pages by, for example, posting comments or liking or sharing posts, any personal information that you post in these interactions or provide when registering for such social media, can be viewed and used by others. We may use such public information you provide on our social media to send you targeted marketing offers. We do not control the use or storage of the information that is collected and processed by social media websites, including how your information is used if you are logged into your social media account when you access our social media page(s). We collect info when you contact us. When you contact us or we contact you, we may monitor or record that communication for quality assurance, training and security purposes.

We collect information about you from others. We may obtain information about you from other sources, including from companies that collect consumer information such as demographic and interest data. In addition, if you access third-party services, such as Facebook, Google, or Twitter, from our sites or apps, to log into our sites or apps, or to share information about your experience, we may collect information from these third-party services.

We may use the information we collect about you or that you provide to us for one or more of the following purposes; namely, to:

  • Fulfill your requests for products, services, information and customer support;

  • Monitor and provide support for our products and services;

  • Determine products and services that may interest you and market them to you;

  • Analyze the use of sites, apps, and services for our purposes, such as product and service enhancements;

  • Research and develop new products and services;

  • Authenticate you;

  • Help maintain the safety, security, and integrity of our Website, products and services, and databases;

  • Improve our Website and advertise our services. Through our use of automatic data collection mechanisms, we are able to understand how our Website is being used, to measure the effectiveness of our Website, to customize our advertising and the content you see when you use our sites and apps, and to use and analyze target markets;

  • Personalize your Website experience and to deliver content and product and service information and offerings relevant to your interests or location, including providing such information or offer via email;

  • Notify you about changes to our Website or any products or services we offer or provide through it;

  • Register you as a visitor if, for example, you visit one of our offices;

If you are submitting information on behalf of another party, we expect that you have received appropriate consent, according to applicable privacy regulations, before transferring any personal information to MarketSpark.

  1. DISCLOSURE OF INFORMATION

We may share information about you in the following ways:

Authorized service providers and partners. We share your information with service providers and partners that help us with a variety of things, including the development and delivery of our sites, apps, and service, and to assist us in collecting payment for billed products and services. This includes services provided by others to help us with analytics which may include storing and accessing cookies and other information on your computer or wireless device.

Affiliates. We share customer information with our affiliates, including the Verizon and Oath family of companies, for a variety of purposes, including, for example, providing you with the latest information about our products and services and offering you our latest promotions. You can limit the sharing of certain types of customer information, known as Customer Proprietary Network Information, or CPNI, within the Verizon family of companies for marketing services to you that are different from your current MarketSpark services. See “Your Choices,” below.

Business Transfers. We may share your information in connection with a transaction (defined above) where personal information held by MarketSpark about you is among the assets being transferred.

Legal purposes. We may disclose information (1) to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries and in emergencies such as those involving the danger of death or serious injury to any person; (2) to advance, protect or defend the rights, interests, property, safety, and security of MarketSpark, our affiliates, users, or the public; (3) to identify, protect against, and address unauthorized or unlawful use of our sites, apps or service, or our network; and (4) to outside auditors and regulators.

Aggregated and De-identified Information. We may aggregate or otherwise de-identify information, such that the information does not identify any individual, and use it without restriction for our own purposes or share it with third parties for their own purposes.

With your consent. We may share information for any other purposes disclosed to you at the time we collect the information pursuant to your consent or through your intentional action.

Links to other sites. We may provide links to other websites for your convenience and information. These websites operate independently from us and are not under our control. We suggest that you review the privacy notices and terms of use for these websites if you visit any linked website. We are not responsible for the content of these sites, any products or services that may be offered through these sites, or any other use of the linked websites.

We use  security measures designed to protect information from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction. However, we cannot guarantee the security of your personal information.

  1. YOUR CHOICES

You have choices about certain ways we use and share information about you.

Customer Proprietary Network Information. MarketSpark customers may choose to limit the use and sharing of Customer Propriety Network Information (or “CPNI”) among MarketSpark’s affiliates, which includes the Verizon family of companies, for the purpose of marketing communications-related services that are different from those you currently have. CPNI is information that relates to the type, quantity, destination, technical configuration, location, amount of use and related billing information of your telecommunications or interconnected Voice over Internet Protocol (VoIP) services. Federal law governs our use and sharing of CPNI. Notice about MarketSpark’s use and sharing of CPNI and the choices you have may be provided in your online statement or in other ways.

Recordings. MarketSpark customers may request that we record inbound and/or outbound RTP data for troubleshooting purposes, which may include the audio recordings of all calls made during the troubleshooting time period. MarketSpark will activate such recording of all RTP only upon on the customer’s request and then will turn off the recording option when the troubleshooting is completed. Any data recorded will be deleted after 30 days or when the cumulative data that MarketSpark has reached for all customers’ recordings exceeds 1GB in storage space.

Marketing. You have choices about receiving marketing from MarketSpark. If you would like to be removed from MarketSpark’s email marketing list, you can opt-out by following the unsubscribe instructions, found at the bottom of the marketing email.

Cookies. You may be able to refuse or disable cookies by adjusting your web browser settings, as described above, by opting out of cookies through our cookie banner link. Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section). If you choose to refuse, disable, or delete these technologies, some of the functionality of our apps or sites may no longer be available to you.

Do-Not-Track Signals and Similar Mechanisms. Some web browsers transmit “do-not-track” signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

  1. CALIFORNIA PRIVACY RIGHTS

We are required to disclose information, upon request, to our California customers and to allow California residents under age 18 who are registered users to request removal of information they have publicly posted.

California Shine the Light. We provide California residents with the option to opt-out of sharing “personal information”, as defined by California’s Shine the Light” law, with third parties (other than with MarketSpark affiliates) for such third parties’ own direct marketing purposes. A business subject to California Civil Code section 1798.83 is required to disclose to its California customers, upon request, the identity of any third parties to whom the business has disclosed personal information within the previous calendar year, along with the type of personal information disclosed, for the third parties’ direct marketing purposes. Please note that under California law, businesses are only required to respond to a customer request once during any calendar year.

California Notice for Minors. We may offer interactive services which allow teens under the age of 18 to upload their own content (e.g., videos, comments, status updates, or pictures). This content can be removed or deleted any time by sending us a request at privacy@marketspark.com. Your request should include a detailed description of the specific content or information to be removed. Please be aware that such posts may have been copied, forwarded, or posted elsewhere by others and we are not responsible for any such actions. You will, in such cases, have to contact other site owners to request removal of your content. Further, your request does not guarantee complete or comprehensive removal of content or information posted online as there may be exceptions and the law may not permit or require removal in certain circumstances.

  1. INTERNATIONAL USERS

Our sites, apps, and service are designed for and targeted to U.S. audiences and are governed by and operated in accordance with the laws of the U.S. We make no representation that our apps, sites or services are operated in accordance with the laws or regulations of any other nation. By using our apps, sites or services, and providing us with any personal information or data, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy.

  1. CHANGES TO THE PRIVACY POLICY

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the  date above, which shows when the Policy was last updated, and post the new Privacy Policy.
